South Africa’s long-anticipated partnership with Elon Musk’s Starlink—an internet game-changer already lighting up skies across the continent—has stalled, and the sticking point is clear: the country’s strict Black Economic Empowerment (BEE) laws.
At stake is a deal worth over R500 million, one that could connect thousands of rural schools, clinics, and communities to fast, low-latency internet. But for now, regulatory deadlock is holding it back.
The Promise of Starlink
Starlink, a division of Musk’s SpaceX, uses low-Earth orbit satellites to beam high-speed internet to even the most remote corners of the globe. Already active in neighboring countries like Botswana, Mozambique, Nigeria, and Zambia, Starlink is transforming education, entrepreneurship, and emergency services where fiber optics and mobile networks fail.
South Africa, however, remains an outlier. Despite having the infrastructure and a clear need for rural connectivity, Starlink has yet to receive the necessary operating licenses to legally launch its services in the country.
The Regulatory Roadblock
At the heart of the delay is a policy clash: South Africa’s Electronic Communications Act requires telecom licensees to be at least 30% black-owned. Starlink, being wholly owned by the U.S.-based SpaceX, does not meet this condition—and has so far resisted selling local equity.
Minister of Communications and Digital Technologies Solly Malatsi has hinted at a possible workaround. He’s floated the idea of accepting “equity equivalents,” where foreign companies invest in local development programs instead of ceding ownership. But this is not yet formal policy—and South Africa’s Independent Communications Authority (ICASA) is legally bound by the existing rules.
Civil society organizations are divided. Some argue that the country should make an exception to accelerate rural internet access. Others warn that bypassing BEE requirements would set a dangerous precedent, undermining transformation efforts and disadvantaging local entrepreneurs.
R500 Million: More Than Just a Number
While Starlink’s actual licensing costs are unclear, the R500 million figure reflects a combination of infrastructure deployment, technical setup, ground station investments, import duties, potential equity arrangements, and local partnerships.
Several South African ISPs have reportedly been in talks to distribute Starlink services domestically. These deals are also on ice—waiting for a green light that never seems to come.
A Missed Opportunity?
President Cyril Ramaphosa met with Elon Musk in 2024 in an attempt to revive negotiations. Hopes were high, especially with South Africa seeking innovative ways to bridge the digital divide. But nearly a year later, no formal breakthrough has emerged.
Meanwhile, the rest of the continent is embracing Starlink. In Kenya, remote hospitals are using it for real-time diagnostics. In Nigeria, farmers are tapping into weather and market data via Starlink-powered apps. South Africa, with its sophisticated tech sector and deep digital ambitions, risks being left behind.
Connectivity vs. Compliance: Finding Common Ground
The real question now is: Can South Africa modernize its policies without compromising its values?
A possible path forward could involve:
- Enacting formal equity-equivalent legislation
- Structuring public-private development funds with Starlink contributions
- Partnering with local black-owned ISPs as distributors
- Defining time-limited exemptions with measurable rural impact milestones
None of these are simple. But doing nothing risks losing a R500 million investment—and more critically, delaying essential services in under-connected regions.
South Africa stands at a digital crossroads. Starlink could bring affordable, transformative connectivity to millions. But the country must decide whether it can make room for innovation within its regulatory framework—or whether policy rigidity will cost it another leap forward in the 21st century digital race.
